Arbitration & Concilation

Alternative dispute resolution is best contemplated in a business relationship before disputes arise. By agreeing on alternative dispute resolution in a main contract, the parties can often shorten or avoid time consuming and costly adjudication of disputes by courts. Our lawyers are skilled in evaluating each situation and incorporating into the relevant contracts and policies of our clients those dispute resolution processes that best suited to their circumstances.

CONCILATION

Conciliation is the most common form of alternative dispute resolution. It permits the parties to design and control the resolution of their dispute and helps disputing parties to achieve a satisfactory resolution of their conflicts. It is often a required step before a matter can be litigated before the court but can also be sought privately at an earlier stage in a dispute.

Main benefits:

  • Conciliation ensures party autonomy.
  • The parties can choose the timing, language, place, structure and content of the conciliation proceedings.
  • Conciliation ensures the expertise of the decision maker.
  • The parties are free to select their conciliator. A conciliator does not have to

have a specific professional background. The parties may base their selection on criteria such as; experience, professional and / or personal expertise, availability, language and cultural skills. A conciliator should be impartial and independent.

  • Conciliation is time and cost efficient.
  • Due to the informal and flexible nature of conciliation proceedings, they can be conducted in a time and

cost-efficient manner.

  • Conciliation ensures confidentiality.
  • The parties usually agree on confidentiality. Thus, disputes can be settled discretely and business secrets will

remain confidential.

ARBITRATION

Arbitration is a form of alternative dispute resolution outside the court process. The parties to a dispute refer it to arbitration and agree to be bound by the arbitration decision.

Less formal than court proceedings, it can be quicker and more cost effective. Our lawyer have extensive experience in resolving disputes in a wide variety of matters including business transactions, marine and aviation issues and construction disputed among others.

As advocates, our lawyers have represented clients in business disputes before domestic and international arbitration under the rules of a variety of arbitral institutions.
